Workers’ Compensation Attorney Group Chicago

The Independent Medical Review (IMR) was established in July 2013 as a quick, non-judicial alternative to resolving medical treatment disputes outside costly litigations in the cases of injured workers. However, the experience of the lawyers at Workers’ Compensation Attorney Group in Chicago says that the effectiveness and fairness of IMR is doubtful.
When a worker is injured while performing job-related duties, the treating physician has to apply for a certain course of treatment to be approved by the utilization review (UR). This body decides whether the treatment is medically necessary. If the treatment is denied, delayed or modified, the injured worker has the right to appeal for independent medical review.
The lawyers from the Group emphasize that the utilization review physician is generally a healthcare professional from another state who has never seen the patient and who never gets to examine the worker personally, yet they are authorized to decide on the reasonableness of treatment. In the case that the request is denied on time, the worker has no other recourse than to seek IMR.
The latest study conducted by California Workers’ Compensation Institute looked into the IMR results for 2015. The report says that IMR continues to uphold the rulings of UR in as many as 88.6% of cases. The majority of cases pertained to prescription drugs, medical equipment, physical therapy, injections and scans. Regardless of what the requested service was, the IMR physician supported the UR decision in between 80% and 90% of cases.
The fact that UR and IMR are represented by anonymous faces who never get to evaluate the patient in person is hugely problematic. In addition, these steps also make the process more discouraging to begin with, especially when you take into consideration that IMR is highly likely to simply uphold the decision reached by UR.
What further compounds the problem, in the opinion of the Group, is that the judicial power has been taken away from the Workers’ Compensation Appeal Board and given over to the non-judicial IMR, which hasn’t demonstrated much inclination toward helping the injured workers relieve their injuries.
